California Governor Newsom Suspends CEQA and California Coastal Act

Issued on January 12, 2025, under a proclaimed State of Emergency, California Governor Gavin Newsom signed Executive Order N-4-25 to streamline rebuilding efforts for homeowners and business affected by the fires. ‍Key provisions include suspending the California Environmental Quality Act (CEQA) and the requirement to obtain permits under the California Coastal Act for projects that involve the repair, restoration, demolition, or replacement of properties that were substantially damaged or destroyed by the fires.

Issued on January 12, 2025, under a proclaimed State of Emergency, California Governor Gavin Newsom signed Executive Order N-4-25 to streamline rebuilding efforts for homeowners and business affected by the fires. 

Key provisions include suspending the California Environmental Quality Act (CEQA) and the requirement to obtain permits under the California Coastal Act for projects that involve the repair, restoration, demolition, or replacement of properties that were substantially damaged or destroyed by the fires. The suspension applies to projects in the same location as damaged structures, not exceeding 110% of the original size and height. This presents a game-changer for coastal homeowners because it eliminates the lengthy delays caused by the California Coastal Commission’s onerous permitting requirements. 

Additional provisions include:

Price Gouging Extension: an extension of California’s price gouging law (Penal Code section 396) to January 7, 2026 in Los Angeles County, covering essentials like building materials and repair services. 

State Agency Actions: agencies must report within 30 days (with 60- day updates) on other rebuilding barriers and suggest additional suspensions. The Department of Housing and Community Development (HCD) will review building codes within 60 days and recommend changes to reduce delays or costs.

Local Permitting: HCD will work with local governments to speed up permitting, targeting residential reconstruction permits within 30 days.

Legislative Coordination: The Governor’s administration will collaborate with Legislature on laws to address rebuilding challenges, including fire-hardening incentives and improved fire response capacity.
